What is Mandatory Inclusionary Housing?

Mandatory Inclusionary Housing (MIH), enacted in March 2016, requires a share of new housing in medium- and high-density areas that are rezoned to promote new housing production—whether rezoned as part of a city neighborhood plan or a private rezoning application—to be permanently affordable.

Within geographies established as MIH areas, the text amendment requires permanently affordable housing set-asides for all developments over 10 units or 12,500 zoning square feet, or, as an additional option for

developments between 10 and 25 units (or 12,500 and 25,000 square feet)a payment into an affordable housing fund. MIH requires permanently affordable housing within new residential developments, enlargements, and conversions from non-residential to residential use within subsequently mapped MIH areas. Developments, enlargements or conversions that do not exceed either 10 units or 12,500 square feet of residential floor area are exempt from the requirements of the program. HPD is responsible for the administration of MIH Program.

ULURP (Uniform Land Use Review Procedure) and Community Outreach Services
The New York City Charter requires certain actions that are reviewed by the City Planning Commission to undergo a Uniform Land Use Review Procedure (ULURP). ULURP is a standardized procedure whereby applications affecting the land use of the city would be publicly reviewed. The Charter also established mandated time frames within which application review must take place. Key participants in the ULURP process are now the Department of City Planning (DCP) and the City Planning Commission (CPC), Community Boards, the Borough Presidents, the Borough Boards, the City Council and the Mayor.
Administrative Agent Services
HANAC is an HPD approved Administering Agent. The Administering Agent is responsible for ensuring compliance pursuant to an Inclusionary Housing Program, Cure, or Privately Financed Affordable Senior Housing (PFASH) Regulatory Agreement or Restrictive Declaration. The guidelines for such Agreements/Declarations are set forth in the New York City Zoning Resolution and the Rules of the City of New York, Title 28, Chapter 41, Section 41-02. In Mandatory Inclusionary, Voluntary Inclusionary, Cure, and PFASH Programs, the Administering Agent responsibilities shall include, but not be limited to, the rental and re-rental of Inclusionary/PFASH/Cure units, lease review, tenant selection, income verification, and ongoing compliance with the Regulatory Agreement or Restrictive Declaration.
